According to the San Marino Tribune, Los Angeles Superior Court Judge Charles Palmer has dismissed what remained of GUNS N’ ROSES singer Axl Rose‘s lawsuit against video game giant Activision Blizzard. Rose sued the company in November 2010, claiming that it used an image of former GUNS guitarist Slash in Guitar Hero III after promising him that the game would not feature any reference to Rose’s ex-bandmate. Rose claimed that was a condition of him agreeing to license the song “Welcome To The Jungle” for use in the game.

Palmer heard more than two hours of arguments on January 31 concerning the lawsuit’s contract claims before taking the case under submission. On Thursday (February 7), he affirmed his tentative ruling and tossed out the remaining causes of action.

Palmer previously indicated that he was inclined to dismiss Rose‘s suit because the singer did not file it until a full three years after the game’s October 2007 release. Rose has said that he was not aware of Slash‘s image in the game until later, although documents in the case indicated that an attorney for the rocker e-mailed Activision about it around the time the game came out.

Rose said in a deposition, “The reason I did not file a lawsuit is because Activision — through my managers and representatives — offered me a separate video game and other business proposals worth millions of dollars to resolve and settle my claims relating to Guitar Hero III.”

He added, “From December 2007 through November 2010, Activision was offering me a GUNS N’ ROSES-dedicated video game, a game dedicated to music from the ‘Chinese Democracy’ album, and other proposals.”

Although Rose‘s legal team tried to point to emails suggesting that an agreement was in place for Activision to not use any images or music related to Slash, Judge Charles Palmer responded, “The only extrinsic evidence supports Activision‘s interpretation and does not support Rose‘s interpretation.”

According to the Hollywood Reporter back in August 2012, a hearing was held in a Los Angeles courtroom concerning a $20 million lawsuit brought by vocalist Axl Rose against Activision Blizzard for featuring former GUNS N’ ROSES bandmate Slash in Guitar Hero III.

By the end of the hearing, the judge indicated that he was going to toss Rose’s fraud claim but allow his breach-of-contract claim to continue, setting up a potential trial in February. 2013

The Hollywood Reporter has issued a follow-up here stating that, at a summary judgment hearing on Thursday (January 31st), Los Angeles Superior Court Judge Charles Palmer reportedly indicated that he is inclined to dismiss Rose’s $20 million lawsuit against Activision Blizzard for fraudulently inducing him into authorizing ‘Welcome to the Jungle’ for use in the popular video game. At the conclusion of the hearing, according to an attorney involved in the case, the judge took the matter under submission.

In the lawsuit, Rose claimed he was told during negotiations that the game wouldn’t feature any reference to Slash, the guitarist with whom he has been famously feuding for two decades.

The possibly fatal problem for Rose was not moving soon enough on the allegations.

The singer’s lawsuit wasn’t filed until late November 2010 — more than three years after the game October 2007 release. Rose has had difficulty claiming that he didn’t discover the problem at an early stage. According to documents filed in the case, Rose’s agent sent Activision an email objecting around the time the game came out.

During the course of the case, Rose attempted to explain why he hadn’t filed a lawsuit right away.

“The reason I did not file a lawsuit is because Activision — through my managers and representatives — offered me a separate video game and other business proposals worth millions of dollars to resolve and settle my claims relating to GHIII,” he said in a deposition. “From December 2007 through November 2010, Activision was offering me a Guns N’ Roses-dedicated video game, a game dedicated to music from the Chinese Democracy album, and other proposals.”

Palmer is inclined to rule that the agreement relied at least on oral promises and was subject to a two-year statute of limitations. “The only extrinsic evidence supports Activision’s interpretation and does not support Rose’s interpretation,” the judge ruled in a tentative order that was recorded by a legal newswire.

A full decision should be coming within weeks.

McManus Entertainment has announced the return to Australia of one of the world’s greatest rock bands, GUNS N’ ROSES in March. Joining Guns N’ Roses will be special guests ZZ TOP and Aussie rockers ROSE TATTOO.

Promoter Andrew McManus says, “I can’t wait for these shows next March. Axl Rose is a legend and I can’t wait to see Guns N’ Roses play to their legion of Aussie fans again. I’m so proud to be bringing them back to Australia and am looking forward to a great tour with fellow rockers ZZ Top and Rose Tattoo.”

Hard rockers Guns N’ Roses were last in Australia in 2010. Guns N’ Roses are Axl Rose, DJ Ashba (guitar), Dizzy Reed (keyboards), Tommy Stinson (bass), Richard Fortus (guitar), Ron ‘Bumblefoot’ Thal (guitar), Chris Pitman (keyboards) and Frank Ferrrer (drums).

Guns N’ Roses’ special guests on their Australian tour are the legendary Texan trio, ZZ Top. ZZ Top’s image has been as unchanging and memorable as their music. ZZ Top have been together for more than 40 years and were inducted by Keith Richards into the Rock and Roll Hall of Fame in 2004. The band’s iconography – beards, cars, girls and that magic keychain – transcend all bounds of geography and language. They’ve been referenced in countless cartoons and sitcoms and are true rock icons. Billy F Gibbons is one of America’s finest blues guitarists while Dusty Hill on bass and Frank Beard on drums (ironically the only member without a beard) provide the ultimate rhythm section support.

Rose Tattoo join Guns N’ Roses and ZZ Top on the Tour. The lineup features lead vocalist Angry Anderson, Dai Pritchard, Paul DeMarco, Geordie Leach and Randall Waller. Rose Tattoo is touted as the best bar-room-blues based rock band in the world and one of the most revered bands of all time. Inducted into the ARIA Hall of Fame in 2006, their hits include ‘Bad Boy for Love’, ‘Rock ‘n’ Roll Outlaw’, ‘Nice Boys’, ‘We Can’t Be Beaten’ and ‘Scarred for Life’.

Aussie rock fans can expect a hard-rocking performance from a hard-rocking lineup!

Tickets go on sale through various outlets on Friday, January 25 at 9am.

Tour dates:

12 – Sydney, NSW, Australia – Allphones Arena

Original GUNS N’ ROSES guitarist Izzy Stradlin has released a new single, “Baby-Rann”. It features Izzy on guitar and vocals, bassist J.T. Longoria, JU JU HOUND guitarist Rick Richards and ex-REVEREND HORTON HEAT drummer Taz Bentley. The video below was edited by Ed Shiers and filmed earlier this month at Oceanway Studios in Hollywood, California.

Stradlin‘s last two iTunes-only albums, “Smoke” (December 2009) and “Wave Of Heat” (July 2010) featured guest appearances by Stradlin‘s former GUNS N’ ROSES bandmate Duff McKagan (bass).

In 2010, Stradlin appeared as a guest on his former GN’R bandmate Slash‘s first solo album. He performs rhythm guitar on the first track, “Ghost”.

Both Izzy and GUNS N’ ROSES lead singer Axl Rose skipped the band’s April 2012 induction into the Rock And Roll Hall Of Fame.

Stradlin issued a statement the week before the induction, thanking his bandmates, the Hall Of Fame for “the acknowledgment of our works over the years,” and the fans who “have supported GUNS N’ ROSES from day one.”

The Indendent recently conducted an interview with legendary guitarist Slash (VELVET REVOLVER, GUNS N’ ROSES). A few excerpts from the chat follow below.

On pop singer Adele:

Slash: “She’s great. She’s a shot in the arm for this industry. She writes her own music that’s not at all contrived. And she’s managed to sell loads of records which makes her a great example to the younger artists. Like Amy Winehouse, she’s organic and real. It’s great to have that happen at this moment when everybody else is so synthetic.”

On his opinion that much of the best music lately has come from British women:

Slash: “Amy Winehouse was great. God bless her. She was one of the purest artists to come out for a long time. Most of those who have come out are female; it’s not the male-dominated rock and roll icons of my generation. It’s refreshing.”

On GUNS N’ ROSES:

Slash: “I still look back on it being the ultimate pre-adult, post-adolescent experience. But I simply don’t think you and I would be speaking had I tried to carry on. I’m a pretty durable survivor and I’m fortunate to be here anyway. But I think if I’d kept trying to negotiate that existence, I wouldn’t be here.”

On his children, London, 9, and Cash, 7:

Slash: “I want to make sure that I instil in my children some of the values that kept me grounded growing up. In the midst of all the drugs and the booze and the chicks, no matter how crazy I have been, there was always a decorum and set of manners. A lot of that came from my parents and wider family.”
